“Extremely serene” : this is the feeling expressed by the Keeper of the Seals, Eric Dupond-Moretti, after the long search carried out Thursday in his offices at the Ministry of Justice. In the Sunday Newspaper (JDD) of July 4, it implicates, without directly naming it, the main magistrates’ union.
“One of the magistrates’ unions which lodged a complaint declared, after my appointment, that she was a “declaration of war”. The same union said Thursday that the complaint was only filed for the sole purpose of being indicted. Everything is here “, asserted Mr. Dupond-Moretti.
The union, implicitly called into question by the minister, is the Union Syndicale des Magistrates (USM), the majority union among magistrates.
“To name such a divisive personality who despises magistrates to such an extent is a declaration of war on the magistracy”Céline Parisot, president of the USM, told Agence France-Presse (AFP) when Mr. Dupond-Moretti was appointed as Keeper of the Seals in July 2020.
Suspected of conflict of interest
“The goal of this union is to get a new Keeper of the Seals. This is not what the Constitution provides … It is from the Prime Minister and the President of the Republic that I derive my legitimacy, and from them alone ”, added the Minister of Justice targeted by an investigation by magistrates of the Court of Justice of the Republic (CJR) on possible conflicts of interest between his action as a keeper of the seals and his former duties as a lawyer.
Mr. Dupond-Moretti is suspected of having taken advantage of his duties as Minister of Justice to intervene in cases for which he was previously a lawyer. “I followed the recommendations of my administration”, defended Mr. Dupond-Moretti in the JDD.
After taking office, the Keeper of the Seals seized the General Inspectorate of Services to request administrative inquiries against three magistrates of the National Financial Prosecutor’s Office (PNF), including its former chief, Eliane Houlette, about the ‘said case “Fadettes” and against Edouard Levrault, a former investigating judge seconded to Monaco. In these two cases, Mr. Dupond-Moretti was counsel for the persons involved.
Denouncing a situation of conflict of interest of the Minister in these two cases, the Anticor association then the two main magistrates’ unions, the USM and the Magistrate’s Union (SM, classified on the left) filed a complaint in the fall in front of the CJR. Since then, Mr. Dupond-Moretti has been removed from the monitoring of his former business, now under the control of Matignon. According to Chained duck, Mr. Dupond-Moretti should soon be summoned by the magistrates of the CJR and risks an indictment.
