New questions around the Yannick Agnel case, indicted for rape and sexual assault on a minor

Within the Mulhouse Olympic Swimming (MON) club, who knew? The question has been raised since the publication, Thursday, January 13, of an article by Radio France’s investigation unit on the Yannick Agnel affair. Indicted in December 2021 for “rape and sexual assault on a 15-year-old minor”, the former swimmer and two-time Olympic champion at the 2012 London Games is the subject of a complaint filed in July 2021 by N. Horter, the daughter of her ex-trainer at MON, Lionel Horter.

In front of the investigators, Yannick Agnel, 29, recognized the “Materiality of the facts alleged against him”, according to the prosecutor of the Republic of Mulhouse, Edwige Roux-Morizot, but he “Had not had the feeling that there had been coercion”. “The charges are rape and sexual assault”, detailed in December Mme Roux-Morizot, explaining that they had taken place in Mulhouse “Over the whole of 2016”.

“It also happened in Thailand, in Rio de Janeiro [au Brésil, ville hôte des JO 2016] and in Tenerife [Canaries] », she added, explaining that the alleged victim was 13 years old at the time of the facts and Mr. Agnel, 24 years old. In 2016, the latter was staying with the Horter family, in the suburbs of Mulhouse. He had joined MON two years earlier.

The secrets of a former club executive

According to the investigation unit of Radio France, the parents of N. Horter would have told the investigators to have learned the facts in the summer of 2021: their daughter would have put them in the confidence fifteen days before the filing of her complaint.

However, a former executive of the club told Radio France a “Episode dating back to late March-early April 2019”. At the time, a financial dispute opposed the MON, led since 2017 by Franck Horter, Lionel’s brother, and Yannick Agnel: the ex-swimmer claims 60,000 euros for his final year of contract with the club. A conciliation letter would then have been sent by the club to Yannick Agnel.

« Franck Horter tells me that Yannick would be wise to accept this conciliation, tells this old executive, because they have a file on him and his niece, N. ”, told this former MON executive to Radio France. “We confirm to you that the parents did not know [les faits] than in 2021 “, declare, however, to World Isabelle Rollet and Thomas Wetterer, lawyers for the alleged victim, N. Horter, now 19 years old.

While the MON is targeted by several legal proceedings in Mulhouse and has been ordered by the courts to pay the sum of 60,000 euros to Mr. Agnel – an appeal trial is due to be held in March – N. Horter’s lawyers say that“There is, to our knowledge, and absolutely certain, no link” between the complaint filed by their client and the financial dispute between the Horter clan and the ex-swimmer. “Our client is a victim and is certainly not the armed wing of her parents”, add Mis Rollet et Wetterer.
